What is the overtime calculation in California?

The general overtime provisions in California are that a nonexempt hourly employee 18 years of age or older is entitled to receive overtime and doubletime for working more than 8 hours in any workday or more than 40 hours in any workweek. Typically an individual who is exempt from the overtime provisions are typcially classified as executive, professional, etc and typically paid on a salary basis.

Regular Hours

Regular rate of pay for all hours worked until 8 hours in any workday and under 40 hours in the workweek.

Overtime Hours

  1. 1.5 times the employee's regular rate of pay for all hours worked in excess of eight hours up to and including 12 hours in any workday.
  2. 1.5 times the employee's regular rate of pay for the first eight hours worked on the seventh consecutive day of work in a workweek.

Doubletime Hours

  1. Double the employee's regular rate of pay for all hours worked in excess of 12 hours in any workday.
  2. Double the employee's regular rate of pay for all hours worked in excess of eight on the seventh consecutive day of work in a workweek.
